FULL RECOMMENDATION
SECTION 13(9), INDUSTRIAL RELATIONS ACT, 1969 PARTIES : HSE/ NATIONAL AMBULANCE SERVICE - AND - A WORKER (REPRESENTED BY SERVICES INDUSTRIAL PROFESSIONAL TECHNICAL UNION) DIVISION :
SUBJECT: 1.Appeal of Adjudication Officer Recommendation No. ADJ-00025884. On the 17 June 2020, the Adjudication Officer issued the following Recommendation: - “I have found some merit in this dispute. I recommend that that the claimant accepts a redeployment to the named post at hearing. However, considering the variance in grading, B13 of the PAS document should prevail. The Employer appealed the Adjudication Officer’s Recommendation to the Labour Court on the 24thJuly 2020 in accordance with Section 13(9) of the Industrial Relations Act, 1969. A Labour Court hearing took place on the 7thOctober 2020.
The Court decides that the parties should proceed on the basis set out above. The decision of the Adjudication Officer is varied accordingly. The Court so decides.
