Complaint seeking adjudication by the Workplace Relations Commission under Section 7 of the Terms of Employment (Information) Act, 1994. | CA-00082102-001 | 23/03/2026 |
Date of Adjudication Hearing: 20/07/2026
Workplace Relations Commission Adjudication Officer: David James Murphy
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background:
The Complainant was employed by the Respondent for a period of approximately four weeks as cleaning and facilities manager to cover another employee on sick leave. The Complainant submitted a complaint under the terms of employment (information) act that the Respondent had failed to provide mandatory training. |
Summary of Complainant’s Case:
The Complainant attended the hearing and made oral and written submissions. She outlined that basic fire and manual handling training was not offered to her by the Respondent, despite her having to work alone in the building. |
Summary of Respondent’s Case:
The Respondent attended the hearing and made written and oral submissions. The Complainant was offered induction training when she started. They accept she was not offered more formalised training in the four weeks she was employed by them. |
Findings and Conclusions:
6G.— Where an employer is required by law or by a collective agreement to provide training to an employee to carry out the work for which he or she is employed, such training shall — (a) be provided to the employee free of cost, (b) count as working time, and (c) where possible, take place during working hours. Both parties accept that the Complainant was not provided with either basic fire safety or manual handling training in the four weeks she was employed by the Respondent. I am not on notice of any law or collective agreement requiring that these training courses are offered within the first few weeks of an employee joining a company. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
I find that the complaint is not well founded. |
