Complaint seeking adjudication by the Workplace Relations Commission under Section 7 of the Terms of Employment (Information) Act, 1994. | CA-00079917-001 | 23/01/2026 |
Date of Adjudication Hearing: 13/07/2026
Workplace Relations Commission Adjudication Officer: David James Murphy
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant worked for the Respondent from the 22nd of April 2024 to the 15th of November 2025. |
Summary of Complainant’s Case:
The Complainant accepts she was provided with a contract of employment when she started with the Respondent. Following the end of her employment in November 2025 she requested a copy of my signed Employment Agreement because she no longer had access to it and wished to understand her contractual position. |
Summary of Respondent’s Case:
The Respondent has made extensive written submissions demonstrating they provided the Complainant with a detailed written employment agreement when her employment started. |
Findings and Conclusions:
Section 3(1) of the act provides that: An employer shall, not later than 2 months after the commencement of an employee’s employment with the employer, give or cause to be given to the employee a statement in writing containing the following particulars of the terms of the employee’s employment. The Complainant does not allege that the Respondent failed to comply with this obligation. Rather her complaint is that, after she ceased being their employee, she sought a further copy of her contract and was not provided with one. The Complainant’s actual complaint is outside the scope of this act. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
I find that the complaint is not well founded. |
