Date of Adjudication Hearing: 29/07/2026
Workplace Relations Commission Adjudication Officer: Brian Dalton
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint(s) to me by the Director General, I inquired into the complaint(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s). A Hybrid hearing was held on the 29th of July 2026 and the Complainant attended by remote link. The Respondent failed to attend. After the hearing the Respondent was contacted about the second complaint brought under the Term of Employment (Information) Act, 1994. No reply was received from the Respondent.
Background:
The Complainant makes the following complaints:
I worked as a barista for KOFFEE AND GOSSIP from 5 November 2024 to 24 November 2024. For this period, I am owed €579.72 gross, which has not been paid to me. Throughout my employment, I repeatedly asked the owner (Kunal Goburdhun) for a written contract or terms of employment, but I was never provided with one. I also had ongoing difficulty receiving wages. The owner (Kunal Goburdhun) frequently told me he would send payment “soon,” but the payment never arrived. When I followed up, he often ignored my messages or was evasive. Due to the continued non-payment of wages and the lack of any written terms, I ultimately left the job because I had no confidence that I would be paid for my work. Since leaving, I have contacted the owner (Kunal Goburdhun) numerous times. He has again said he would send the payment but has still not done so, and he continues to ignore or avoid my messages. I have not received any wages for the work I completed. I am therefore submitting this complaint to recover the full amount owed: €579.72. I also request that the Adjudication Officer consider whether compensation is appropriate for the repeated non-payment of wages and the failure to provide the required written terms of employment
The Complainant received 2 pay slips detailing her gross and net pay but the money was never transferred into her account.
The outstanding amounts are: · Week Ending 2nd of November 2025 €268.92 gross · Week Ending 16th of November 2025 €310.80 gross The Gross total being €579.72.
The employment commenced on the 5th of November 2025 and ended on the 24th of November 2025 when the Complainant left her employment as she alleges she wasn’t being paid. |
Summary of Complainant’s Case:
The Complainant under oath has stated that she was never paid. She also stated that she received no information about her core terms of employment. |
Summary of Respondent’s Case:
The Respondent was not in attendance at the hearing. |
Findings and Conclusions:
The Respondent was not in attendance at the hearing. After the first hearing held in July the Adjudicator wrote to the Respondent at the business address of the shop. On the facts the Respondent has been properly notified of the first hearing date and provided with an opportunity to reply to the second complaint relating to a failure to provide information to the Complainant about her terms and conditions. That complaint was clearly detailed in her complaint narrative written on her form lodged with Commission. I am satisfied that the Respondent was properly notified of the hearing. On the sworn oral evidence of the Complainant I find that the Complainant did not receive payment of €579.72 purported to be paid by credit transfer to her account and was not. That conclusion is further supported by the text messages sent to the employer who promised to pay her and didn’t. The second complaint about being provided with her terms of employment in writing cannot be heard as the Complainant does not have the requisite service to present that complaint to the Commission. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
CA-00078410-001 I find that the Complainant was not paid her gross wages amounting to €579.72 gross which was properly payable to her and order the Respondent to pay this amount to her less any statutory deductions. I find that this complaint is well founded. CA-00078410-002 The Terms of Employment (Information) Act 1994 as amended requires that the Complainant has the following employment service: 1A) An employee shall not be entitled to present a complaint under Part 4 of the Workplace Relations Act 2015 in respect of a contravention of section 3(1A)— (a) unless the employee has been in the continuous service of the employer for more than 1 month, or (b) if the employer concerned has been prosecuted for an offence under this Act in relation to the same contravention. The Complainant commenced her employment on the 5th of November 2025, and it ended on the 24th of November 2025 and therefore the Complainant does not have the requisite 1 month service to bring this complaint. The Complaint is not well founded. |
