Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 8 of the Unfair Dismissals Acts, 1977 - 2015, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant was employed from January 2023 until the end of March 2024. He submitted a complaint against the Respondent in April 2024.
A hearing was held in September 2024 and the Respondent attended and submitted that they were never the Complainant’s employer.
The Complainant requested and was granted an adjournment to potentially submit additional complaints against a different entity and seemed to accept in correspondence that the above-named Respondent was not his employer.
I sought an update in October this year and the Complainant indicated by email he could not proceed as he could not locate the other entity. When asked by way of email if he wanted to withdraw this complaint he did not reply. |
Summary of Complainant’s Case:
The Complainant submits that he was unfairly dismissed. He is unclear as to who his employer was. |
Summary of Respondent’s Case:
The Respondent submits that they were never the Complainant’s employer. |
Findings and Conclusions:
On the basis of the information I have available to me I conclude that there was no employment relationship between the parties and as such the complaint must fail. |
Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
I find that the complaint is not well founded.
