Procedure:
In accordance with section 41 of the Workplace Relations Act 2015, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Ms Bolor-Erdene Daalingaa (the “complainant”) did not attend the hearing arranged for 30 April 2026; Mr Nikish Zen, manager and company secretary, attended the hearing on behalf of The Zen Eir Ltd (the “respondent”).
The complainant did not contact the Commission to advise of or to explain her non-attendance at hearing.
I am satisfied that the complainant was properly notified of the hearing arrangements in accordance with the contact information provided.
The complainant referred this complaint against the respondent but failed to pursue the complaint by her non-attendance at hearing.
I must therefore conclude that the complaint against the respondent is not well founded.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
In circumstances where the complainant failed to attend the hearing in pursuit of her complaint, I conclude that the complaint against the respondent is not well founded and I decide accordingly. |
