Complaint seeking adjudication by the Workplace Relations Commission under Section 12 of the Minimum Notice & Terms of Employment Act, 1973 | CA-00073586-001 | 18/07/2025 |
Date of Adjudication Hearing: 19/05/2026
Workplace Relations Commission Adjudication Officer: Peter O'Brien
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
This matter was heard by way of remote hearing pursuant to the Civil Law
and Criminal Law (Miscellaneous Provisions) Act 2020 and SI 359/20206,
which designates the WRC as a body empowered to hold remote hearings.
In deference to the Supreme Court ruling, Zalewski v Ireland and the
WRC [2021] IESC 24 on the 6th of April 2021 the Parties were informed in advance that the Hearing would be in Public, Testimony under Oath or Affirmation may be required and full cross examination of all witnesses would be provided for. The Hearing too place completely in public.
Background:
The Complainant was employed from 26/10/2022 to 28/5/2025 as a Lorry Driver and submitted a complaint that he was not paid the statutory minimum notice pay on the termination of his employment. The Respondent denied the complaint was dismissed and was due notice pay.. |
Findings and Conclusions:
A complaint was received by the Director General of the Workplace Relations Commission by Alexei Rabacu on 18/7/2025 alleging that the Respondent contravened the provisions of the Minimum Notice and Terms of Employment Act 1973 in relation to him. The said complaint was referred to me for investigation. A hearing for that purpose was held on May 19th 2026 . There was no appearance by or on behalf of the Complainant at the Hearing.. I am satisfied that the said Complainant was informed in writing of the date, time and method at which the Hearing to investigate the complaint would be held. In these circumstances and in the absence of any evidence to the contrary having been adduced before me, I must conclude that the within complaint is not well-founded and I decide accordingly. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
I find that the complaint is not well founded. |
