Date of Adjudication Hearing: 06/05/2026
Workplace Relations Commission Adjudication Officer: Brian Dalton
Procedure:
In accordance with Section 79 of the Employment Equality Acts, 1998 – 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant failed to attend at the hearing. |
Summary of Complainant’s Case:
The Complainant failed to attend at the hearing. |
Summary of Respondent’s Case:
The Respondent attended and was ready to rebut the allegations being made against them. |
Findings and Conclusions:
The Complainant had consented to email communication. I am satisfied that the Complainant was properly notified of the date, time and place of the hearing and failed to attend. In these circumstances I must find that the complaint is not well founded arising from the failure to attend and to present their case. The Respondent attended and was ready to rebut the allegations being made against them. |
Decision:
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
Arising from the failure to attend at the hearing I find that the complaint is not well founded and that the Complainant was not discriminated against. |
