Procedure:
In accordance with Section 8 of the Unfair Dismissals Acts, 1977 - 2015, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard and to present any evidence relevant to the complaint. The hearing was held in the Hearing Rooms of the Workplace Relations Commission (WRC), Carlow. The complainant nor the respondent attended the hearing. After the scheduled hearing an email from the complainant was brought to my attention. This email was sent by the complainant at 10.56 on the morning of the hearing requesting an on-line hearing at 12.30 or the postponement of the hearing.

The complainant submitted a complaint of Unfair Dismissal to the WRC received on 24th June 2025. |
Summary of Complainant’s Case:
There was no attendance by the complainant. I am satisfied that the complainant was on notice of the hearing. |

There was no attendance by the respondent. |
Findings and Conclusions:
The complainant did not attend the hearing to make out his complaint. He sent an email that morning requesting an online hearing or the postponement of the hearing. The WRC guidelines state that postponements will only be granted where there are exceptional circumstances and substantial reasons. The complainant did not submit any supporting documents to evidence that exceptional circumstances existed which prevented his attendance. For the reason outlined, I decide not to grant the postponement. As the complainant did not attend the hearing to make out his complaint, I decide the complaint is not well founded. |
Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
I find the complaint is not well founded. |
