Procedure:

In accordance with Section 41 of the Workplace Relations Act, 2015 & Section 27 of the Organisation of Working Time Act, 1997 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

1: Non-Appearance of Parties

Despite being properly notified of the time, date and place of the Hearing neither party attended.

A period of grace was allowed post the Hearing for receipt of mitigating materials in relation to the Non-Appearance. None were received.

2: Findings and Conclusions:

As neither Party attended, and no evidence was presented, the Complaint was not proceeded with. It was deemed legally Not Properly Founded.

3: Decision:

Section 41 of the Workplace Relations Act 2015 & Section 27 of the Organisation of Working Time Act, 1997requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions of the cited Acts.
