Procedure:
In accordance with section 25 of the Equal Status Act 2000, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard and to present any evidence relevant to the complaint.
On 22 May 2024 the Complainant presented a complaint to the Workplace Relations Commission (WRC). This complaint was scheduled for adjudication on 28 April 2026 at the hearing rooms of the WRC Office in Carlow. There was no appearance by or on behalf of the Complainant. I verified that the Complainant had been served with notice of the time, date, and venue of the adjudication hearing. I waited some time to accommodate a late arrival. I proceeded with the hearing in the absence of the Complainant.

Summary of Respondent’s Case:
The Respondent’s solicitor and a member of the Respondent’s management attended the hearing on 28 April 2026 and were prepared to defend the claim referred against the Respondent. The Respondent’s solicitor outlined that this was the fourth hearing date. All previous hearings had been postponed at the Complainant’s request. The Respondent’s solicitor made an application to strike out the complaint for non-pursuance under s. 48 of the Workplace Relations Act 2015, or that a no-show decision should issue. |
Findings and Conclusions:
The Complainant presented a complaint to the WRC on 22 May 2024. The complaint was listed for hearing on 9 September 2024; 6 January 2025; 23 April 2025; and 28 April 2026. Each scheduled hearing was postponed at the request of the Complainant. The Complainant was notified of the instant hearing on 29 January 2026. On 9 April 2026 the Complainant submitted a postponement application in respect of this hearing date. This application was refused by the WRC. An appeal of the refusal was not upheld by the WRC. The Complainant was advised that the hearing would proceed as scheduled at 11.30am on 28 April 2026. The Complainant did not attend the scheduled hearing to give evidence in relation to her complaint. The Respondent party were in attendance and were prepared to defend the claim referred against the Respondent. I am satisfied the Complainant was notified that the hearing into her complaint was to proceed at 11.30am on 28 April 2026. As the Complainant did not attend the scheduled hearing to give evidence in relation to her complaint, I find the complaint is not well founded. |
Decision:
Section 25 of the Equal Status Acts 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.
