Procedure:

In accordance with Section 39 of the Redundancy Payments Acts 1967 - 2014 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Background:

The Complainant was Visual Assistant with the Respondent from 20 June 2018 until her date of termination on 20 May 2020. It was her complaint that she did not receive any redundancy payment.

The Respondent was a retailer who entered into liquidation in or around 2020.

Summary of Complainant’s Case:

The Complainant attended at the first hearing but did not appear at the second hearing date.

Having reviewed the file and the fact she did attend on the first date, I am satisfied that she was notified of the hearing date based on the contact details she provided to the Workplace Relations Commission.

Summary of Respondent’s Case:

Mr Colum Holland, Solicitor for the Respondent appeared at the hearing.

Findings and Conclusions:

In the absence of the Complainant at the hearing to give evidence in her complaint, I find the Respondent has no case to answer. Accordingly, the complaint is dismissed for want of prosecution.

Decision:

Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.

I disallow the Complainant’s appeal.
