Appeal of Adjudication Officer Decision No's: ADJ-00028156 (CA-00036165-002).
BACKGROUND:
The Worker appealed the Decision of the Adjudication Officer to the Labour Court on the 28 July 2023 in accordance with Section 8 (1) of the Terms of Employment (Information) Acts, 1994 to 2012.
A Labour Court hearing took place on the 26 February 2026.
The following is the Decision of the Court.
DECISION:
Background to the Appeal
This is an appeal by Mr Ion Tataru (‘the Complainant’) from a decision of an Adjudication Officer (ADJ-00028156/CA-00036165-002, dated 21 June 2023) under the Terms of Employment (Information) Act 1994 (‘the Act’). Notice of Appeal was received in the Court on 28 July 2023. The Court heard the appeal in Dublin on 26 February 2026. There was no appearance on behalf of Northway Personnel Limited (‘the Respondent’) at the appeal.
The Complainant’s Evidence
The Complainant told the Court that he had not received a written statement of terms and conditions from the Respondent. He also told the Court that his average gross pay was €735.00 per week.
Discussion and Decision
Based on the Complainant’s uncontested evidence, the Court finds that his complaint under the Act is well-founded. The Court awards the Complainant four weeks’ gross pay in compensation for the breach of the Act, being €2,940.00.
The decision of the Adjudication Officer is set aside.
The Court so decides.
