Workplace Relations Commission Adjudication Officer: Ewa Sobanska
Date of Hearing: 11/03/2026
Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended) following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute.
Background:
The Worker referred his dispute to the Director General of the WRC on 11 August 2024.
A hearing for the purpose of investigation of the Worker’s dispute was scheduled for 11 March 2026. Correspondence informing the parties of the arrangements for the hearing issued on 19 January 2026. There was no attendance by, or on behalf of, the Worker at the hearing. There has been no communication from the Worker indicating any difficulties with attending the hearing or requesting a postponement. The Employer and its representative attended the hearing.

Summary of Workers Case:
There was no attendance by, or on behalf of, the Worker. |
Summary of Employer’s Case:
The Employer and its representative were in attendance. |
Conclusions:
In conducting my investigation, I have taken into account all relevant submissions presented to me by the parties.
At the time the hearing was to commence, it was apparent that there was no attendance by, or on behalf of, the Worker. I am satisfied that the Worker was on notice of the date, time and venue of the hearing to investigate his dispute and I waited some time to accommodate a late arrival. The Worker did not avail of the opportunity to be heard by me and to present any information relevant to his dispute. As of the date of the drafting of this recommendation, there was no communication from, or on behalf of, the Worker, explaining his non-attendance.
|
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
In these circumstances I do not recommend in favour of the Worker. I recommend that the dispute be considered closed. |
