Workplace Relations Commission Adjudication Officer: Brian Dalton
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint(s) to me by the Director General, I inquired into the complaint(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s).
Background:
The Complainant failed to attend at the hearing and was notified at the email address provided and had consented to email communication. It would appear that the complaints were settled and formed part of a settlement agreement. However, the complaints had not been formally withdrawn. |
Summary of Complainant’s Case:
The Complainant failed to attend. |
Summary of Respondent’s Case:
The Respondent attended and was ready to rebut the allegations being made against the Company. |
Findings and Conclusions:
As the Complainant failed to attend at the hearing to present their case and I am satisfied that they were informed of the date, time and place of the hearing the claims must be dismissed for failure to attend. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
I determine that the complaints are not well founded arising from the Complainant’s non-attendance at the hearing. |
Dated: 16th April 2026.
