ADJUDICATION OFFICER DECISION
Adjudication Reference: ADJ-00056528
Parties:
| Complainant | Respondent |
Parties | Jorge Martínez | Wayback Mary Sreet Limited |
Complaint(s):
Act | Complaint/Dispute Reference No. | Date of Receipt |
Complaint seeking adjudication by the Workplace Relations Commission under section 6 of the Payment of Wages Act, 1991 | CA-00068768-002 | 21/01/2025 |
Date of Adjudication Hearing: 08/05/2025 and 17/02/2026
Workplace Relations Commission Adjudication Officer: David James Murphy
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background:
The Complainant raised a complaint against the Respondent. |
Summary of Complainant’s Case:
The Complainant did not attend the hearing. |
Summary of Respondent’s Case:
The Respondent did not attend the hearing. |
Findings and Conclusions:
The Complainant provided his email address when he filed his complaint and gave the WRC permission to notify him of any hearing dates at that email address. On review of the WRC file I can see the Complainant was notified of the hearing by way of email sent to that address. Two hearing dates were arranged. On the first the Complainant did not attend and when he was contacted indicated that there had been an error and asked the matter to be relisted. When it was he again failed to attend. In the circumstances, where the Complainant has not attended the hearing to present his complaint, the complaint fails. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
I find that the complaint is not well founded. |
