Procedure:
In accordance with section 41 of the Workplace Relations Act, 2015 and section 8 of the Unfair Dismissals Acts, 1977 as amended, following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Background:
The Complainant referred his claims to the Director General of the WRC on 11 August 2024.
A hearing for the purpose of investigation of the Complainant’s claims was scheduled for 11 March 2026. Correspondence informing the parties of the arrangements for the hearing issued on 19 January 2026. There was no attendance by, or on behalf of, the Complainant at the hearing. There has been no communication from the Complainant indicating any difficulties with attending the hearing or requesting a postponement. The Respondent and its representative attended the hearing.

Findings and Conclusions:
At the time the hearing was to commence, it was apparent that there was no attendance by, or on behalf of, the Complainant. I am satisfied that the Complainant was on notice of the date, time and venue of the hearing to investigate his complaints and I waited some time to accommodate a late arrival. The Complainant did not avail of the opportunity to be heard by me and to present any information relevant to his claims. As of the date of the drafting of this decision, there was no communication from, or on behalf of, the Complainant, explaining his non-attendance. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
In the circumstances and in the absence of any evidence to the contrary, I declare the complaints: CA-00066998-001 pursuant to section 24 of the National Minimum Wage Act, 2000 CA-00066998-002 pursuant to section 45A of the Industrial Relations Act, 1946 CA-00066998-003 pursuant to section 27 of the Organisation of Working Time Act, 1997 CA-00066998-004 pursuant to section 7 of the Terms of Employment (Information) Act, 1994 CA-00066998-005 pursuant to section 7 of the Terms of Employment (Information) Act, 1994 CA-00066998-006 pursuant to section 45A of the Industrial Relations Act, 1946 CA-00066998-007 pursuant to section 7 of the Terms of Employment (Information) Act, 1994 to be not well founded. |
Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
For the reasons set out above, I decide that the Complainant was not unfairly dismissed and the complaint CA-00066998-008 pursuant to section 8 of the Unfair Dismissals Act, 1977 is not well founded. |
