Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended) following the referral of the dispute(s) to me by the Director General, I inquired into the dispute(s) and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute(s).
Background:
The Complainant failed to attend so that his dispute with his employer could be heard in order to assess the merits of the case and where appropriate make a recommendation to the parties to resolve the dispute. |
Summary of Workers Case:
The worker did not attend the hearing. |
Summary of Employer’s Case:
The employer attended the hearing and was of the view that the dispute had not merit. |
Conclusions:
In conducting my investigation, I have taken into account all relevant submissions presented to me by the parties.
As the worker failed to attend the hearing, I find that his dispute with his employer has no merit |
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute. As the worker failed to attend at his own hearing there is no reality in making a recommendation on the merits of the claim so that the matter might be resolved. I dismiss the claim for failure to attend.
