Procedure:
In accordance with Section 39 of the Redundancy Payments Acts 1967 - 2014 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complaint was lodged with the Commission on the 13th of December 2025. The Respondent wrote to the Commission on the 8th of January 2025 and stated the following:
“Regarding the complaint ref above, we have contacted our accountants in relation to this and are working to resolve this issue as soon as possible and compensate our former employee with redundancy to avoid the need for adjudication in this matter.”
The Respondent attended at the hearing and stated that the Redundancy payment has been paid. |

The Complainant failed to attend at the hearing. |

The Respondent stated that the Complainant had now been paid. |
Findings and Conclusions:
The Respondent attended at the hearing. The hearing letter was sent to the Complainant’s representative on the 19th of March 2026. I am satisfied that he Complainant’s representative as detailed on the complaint form was on notice of the hearing. As the Complainant was on notice and failed to attend, I must find that the complaint is not well founded. |
Decision:
Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
