Procedure:
Using the WRC’s e-complaint referral system, this complaint was submitted to the WRC on December 1st 2025. In accordance with section 41 of the Workplace Relations Act 2015, it was assigned to me by the Director General.
On April 16th 2026, the parties were notified that a hearing would take place on May 25th in the WRC in Lansdowne Road. On May 19th, the complainant sent an email and asked for a video link to attend. Parties who wish to object to a complaint being heard remotely or in-person must do so 10 days in advance of the hearing date. This is clearly outlined on the website of the WRC and, on May 19th, the complainant was informed that the hearing was listed as an in-person hearing. When the hearing opened on May 25th, he was not in attendance.
Mr Edward Mullen is the owner of Bright Star Joinery Limited and he attended at the WRC on May 25th at 9.30am. Mr Mullen said that he is a self-employed carpenter and that he has no employees. When he had a contract in 2025, he said that he offered work to the complainant and paid him an agreed daily rate.
I am satisfied that the complainant was on notice of the hearing, and that he decided not to attend in-person. I have decided therefore to conclude my investigation and close this file.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
In the circumstances where the complainant did not attend the hearing and, in the absence of any evidence to the contrary having been presented, I must conclude that this complaint is not well founded and I decide accordingly. |
