Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background:
The Complainant alleges that €550 was unlawfully withheld on or about the 6th of December 2024 when the amount was properly payable.
The Complainant failed to attend at the hearing.
The Complainant consented to email communication and was informed about the remote hearing on the 29th of April 2026. |
Summary of Complainant’s Case:
The Complainant failed to attend at the hearing. |
Summary of Respondent’s Case:
The Respondent attended and was ready to rebut the allegation being made against them. |
Findings and Conclusions:
I am satisfied that the Complainant was on notice of the remote hearing and failed to attend. As the Respondent was in attendance and ready to rebut the allegations being made against them I must dismiss the claim for failure to attend at the scheduled hearing. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
I am satisfied that the Complainant was on notice of the remote hearing and failed to attend. As the Respondent was in attendance and ready to rebut the allegations being made against them I must dismiss the claim for failure to attend at the scheduled hearing. The Complaint is not well founded. |
