Procedure:
In accordance with Section 8 of the Unfair Dismissals Acts, 1977 - 2015, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant alleges she was unfairly dismissed from her employment. The Complainant failed to appear for the hearing of the matter.

Summary of Respondent’s Case:
Mr Feehan on behalf of the named Respondent stated that he was not the Complainant’s employer. She was employed by a Mr Byrne who leased the kitchen from him. He also applied to have the matter struck out for want of prosecution on the basis that the Complainant failed to appear. |
Findings and Conclusions:
There was no appearance for or on behalf of the Complainant for today’s remote hearing. Having examined the case file I have satisfied that the complainant was on notice of the date, time and venue for the hearing. I am further satisfied that the Complainant was furnished with the hearing link. Attempts were made to contact the Complainant on the mobile number provided by her however those attempts were unsuccessful. The hearing proceeded at 12.15pm having been scheduled to commence at 12 noon. Accordingly, I find that the complaint is not well founded and accordingly fails. |
Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
The complaint fails. |
