Procedure:
In accordance with s. 8 of the Unfair Dismissals Acts, 1977 - 2015, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard and to present any evidence relevant to the complaint.
On 1 June 2025 the Complainant presented a complaint to the Workplace Relations Commission (WRC). This complaint was scheduled for adjudication on 21 May 2026 at the hearing rooms of the WRC Office in Carlow. There was no appearance by or on behalf of the Complainant. A member of the WRC administration team phoned the Complainant. However, the Complainant did not answer the call. I verified that the Complainant had been served with notice of the time, date, and venue of the adjudication hearing. I waited some time to accommodate a late arrival. I then proceeded with the hearing in the absence of the Complainant.
Summary of Complainant’s Case:
The Complainant did not attend the scheduled hearing to give evidence in relation to their complaint. No contact was received by or on behalf of the Complainant prior to or after the hearing to indicate any difficulty with attending the hearing. |
Summary of Respondent’s Case:
Members of the Respondent’s management attended the hearing on 21 May 2026 and were prepared to defend the claim referred against the Respondent. The Respondent also presented a written submission to the WRC in advance of the hearing. This submission was copied to the Complainant. |
Findings and Conclusions:
As the Complainant did not attend the scheduled hearing to give evidence in relation to their complaint, I find the complaint under the Unfair Dismissals Act, 1977 - 2015 is not well founded. |
Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with s. 7 of the 1977 Act.
As the Complainant did not attend the scheduled hearing to give evidence in relation to their complaint, I decide the complaint is not well founded. |
