Procedure:
In accordance with Section 8 of the Unfair Dismissals Acts, 1977 - 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant worked for the Respondent.
She submitted a WRC complaint alleging that the Respondent breached the Unfair Dismissals Act 1977, with respect to her employment.
The Respondent denies the Complainant’s complaints. |
Summary of Complainant’s Case:
The Complainant did not attend the hearing and was not represented.
On 6th March 2026, there was email correspondence from the Complainant’s prior representative, a firm of Solicitors, advising the WRC that it was no longer on record for the Complainant, in respect of these proceedings, due to its inability to obtain instructions from the Complainant. |
Summary of Respondent’s Case:
The Respondent denies the Complainant’s claims.
The Respondent and its representative attended the hearing.
As the Complainant did not attend the hearing, it was submitted the matters should be dismissed for want of prosecution. |
Findings and Conclusions:
The complaint was received by the Director General of the Workplace Relations commission on 10th March 2025, whereby the Complainant alleged that her former employer contravened the provisions of the Unfair Dismissals Act 1977, in relation to her.
The complaint was assigned the following complaint application number: CA-00069870-001.
The said complaint was referred to me for investigation.
A hearing for that purpose was arranged for 10th March 2026.
There was no appearance by or on behalf of the Complainant at the hearing.
The Adjudication Officer allowed a grace period of 15 minutes before commencing the hearing. |
Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
CA-00069870-001: I find for the Respondent.
In all of the circumstances of the matter, I must conclude that the within complaint (CA-00069870-001) is not well-founded and I decide accordingly. |
