Workplace Relations Commission Adjudication Officer: John Harraghy
Date of Hearing: 30/06/2026
Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended) following the referral of the dispute(s) to me by the Director General, I inquired into the dispute(s) and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute(s).
A remote hearing was scheduled for 30 June 2026 and the Worker and Employer were advised of the date, time and connection details. The Employer and a HR representative attended the hearing and were prepared to enter a full defence of all the complaints.
The Worker did not attend the hearing and the WRC tried to contact him at the time that the hearing was due to commence but he was not contactable. There was no postponement application received from the Worker.
After waiting for a period of time the hearing was brought to a conclusion on the basis that the Worker failed to attend. There was no subsequent contact from the Worker to explain his non-attendance.
Background:
The Worker commenced employment with the Employer on 04 April 2025. He resigned on 12 July 2025 after a number of events with which he took issue. He worked 13.07 hours per week and was paid €14.50 per hour. |
Summary of Workers Case:
The worker did not attend the hearing, seek a postponement or make any contact to explain his non-attendance. |
Summary of Employer’s Case:
The employer and a HR representative attended. |
Conclusions:
In conducting my investigation, I have taken into account all relevant submissions presented to me by the parties.
I am satisfied that the Worker was properly notified of the hearing arrangements. I find that his non-attendance at the hearing, without any notification, to pursue these disputes was unreasonable. As the worker did not attend the hearing and therefore, I am unable to make any recommendations. |
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to these disputes:
