Procedure:

This complaint was submitted to the WRC on November 11th 2025 and, in accordance with section 41 of the Workplace Relations Act, it was assigned to me by the Director General.  A hearing was arranged for July 7th 2026 at 9.30am, for the parties to present evidence in respect of the complaint.  When the hearing opened, the complainant, Mr Maid Kalik, was not in attendance and no one was present to represent his former employer, HPL Engineering Limited.  Having checked the case file, I established that, on May 14th 2026, both parties were notified by post of the date of the hearing.  I am satisfied that the notices were sent to the correct addresses of both parties.  By 10.00am, when neither party was present, and, with no contact regarding an explanation for not attending, I reached the decision set out below.     

Decision:

Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.

In the circumstances in which the complainant and the respondent did not attend the hearing, and in the absence of any evidence to the contrary having been submitted, I must conclude that this complaint is not well-founded and I decide accordingly.
