Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and/or Section 8 of the Unfair Dismissals Acts, 1977 - 2015, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint. This matter was heard by way of remote hearing pursuant to the Civil Law and Criminal Law (Miscellaneous Provisions) Act, 2020 and S.I. 359 of 2020, which designates the WRC as a body empowered to hold remote hearings.
Background:
The Complainant contends she was unfairly dismissed. The within complaint was received on 14 November 2025. Correspondence received by the WRC stated that Four Star Pizza (Ireland) is not the employer of the Complainant.
Summary of Complainant’s Case:
The Complainant stated that she had received advice from Citizens Information Centre that the complaint should be addressed to the Head Office of Four Star Pizza. Her payslips had ZZ Ltd t/a Four Star Pizza Cork. Another complaint with the correct name of the employer has been lodged.
Summary of Respondent’s Case:
The representative of ZZ Ltd t/a Four Star Pizza Cork confirmed to the hearing that the wrong employer was named in the complaint and there is no agreement to change the name in the current complaint.
Findings and Conclusions:
It is common case that the wrong Respondent/employer has been impleaded. I have no jurisdiction to investigate the complaint. The complaint in its current format is not well founded.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
For the reasons and findings above, I have decided that the complaint has been lodged against the wrong respondent and is not well founded.
