Procedure:
In accordance with Section 39 of the Redundancy Payments Acts 1967 - 2014 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard and to present any evidence relevant to the complaint. The hearing was held in the hearing rooms of the Workplace Relations Commission, Carlow. The complainant, Mr. Crotty attended the hearing and gave evidence under oath. The respondent did not attend the hearing.
As the company is registered on the company registration website as ‘normal’ and the notice of hearing was sent to the correct registered address, I decided to proceed with the hearing.
Background:
Mr. Crotty submitted a complaint to the WRC that when the business closed on 13th October 2025 he did not receive his statutory redundancy. |
Summary of Complainant’s Case:
Summary of Complainant’s Evidence Mr. Crotty gave testimony that he started employment with the respondent on 10th November 2022. He said the business closed on 13th October 2025 and he did not receive a redundancy payment. He said he was in college when the staff were called to a meeting. He heard from a family member that the business had closed which was confirmed when he contacted the owner later that week. He said his gross weekly wage was €114.75 and he worked 8.5 hours per week. |
Summary of Respondent’s Case:
A representative of the respondent did not attend the hearing. I am satisfied that notice of the hearing was sent to the correct business address as per the company registration website. |
Findings and Conclusions:
CA-00076742-001- Redundancy Complaint I am satisfied with the testimony of the complainant that he was made redundant on 13th October 2025. The company owner confirmed that he was made redundant when he contacted him. I allow the complainant’s appeal and find that he is entitled to a statutory redundancy lump sum payment under the Redundancy Payments Acts 1967-2014 as below- -Date of commencement- 10th November 2022 -Date of termination- 13th October 2025 -Gross weekly wage €114.75 This award is made subject to the complainant having been in insurable employment under the Social Welfare Acts during the relevant period. |
Decision:
Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
I allow the complainant’s appeal and find that he is entitled to a statutory redundancy lump sum payment under the Redundancy Payments Acts 1967-2014 as below- -Date of commencement- 10th November 2022 -Date of termination- 13th October 2025 -Gross weekly wage €114.75 This award is made subject to the complainant having been in insurable employment under the Social Welfare Acts during the relevant period. |
