Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

The Complainant submitted a complaint under the payment of wages act against the Respondent. |

The Complainant did not attend the hearing. |

The Respondent did not attend the hearing. |
Findings and Conclusions:
Six days after the hearing, on the 8th of June, the Complainant sent an email to the WRC noting that they had missed the hearing but asking for the case to proceed. They did not outline any reason for having missed the scheduled hearing date. Their non-attendance wasted WRC resources and delayed other complaints, pending hearing, unnecessarily. In the circumstances I do not think it would be reasonable to ask the WRC to issue a further hearing date and I think it is appropriate to issue a decision on the basis that the Complainant did not attend the hearing of their complaint. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
For the reasons set out above I find that the complaint is not well founded. |
