Procedure:

In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

Background:

There was no appearance for or on behalf of either party for the remote hearing today.

Summary of Complainant’s Case:

There was no appearance for or on behalf of the Complainant.

Summary of Respondent’s Case:

There was no appearance or on behalf of the Respondent.

Findings and Conclusions:

There was no appearance for or on behalf of the Complainant for today’s remote hearing. Having examined the case file, I am satisfied that the Complainant was on notice of the date, time and venue for the hearing. I am further satisfied that the Complainant was furnished with the hearing link. Attempts were made to contact the Complainant on the mobile number provided however those attempts were unsuccessful.

The Respondent did log on for the hearing however when the case was due to commence the Respondent had disconnected from the remote hearing link. Attempts were made to contact the Respondent however those attempts were unsuccessful. The hearing was delayed for approximately 30 minutes to allow the parties to log on or to make contact with the WRC. No contact was made, and neither of the parties logged into the hearing.

Accordingly, I find that the complaint is not well founded and accordingly fails.

Decision:

Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.

The complaint fails.
