Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint. This matter was heard by way of remote hearing pursuant to the Civil Law and Criminal Law (Miscellaneous Provisions) Act 2020 and SI 359/20206, which designates the WRC as a body empowered to hold remote hearings. In deference to the Supreme Court ruling, Zalewski v Ireland and the
WRC [2021] IESC 24 on the 6th of April 2021 the Parties were informed in advance that the Hearing would be in Public, Testimony under Oath or Affirmation may be required and full cross examination of all witnesses would be provided for. The Hearing too place completely in public.
Background:
The Complainant was employed as a Senior Office Administrator and sought one week statutory notice pay and two weeks unpaid pay when her employment ended. A Hearing was held into the complaint on May 12th 2026 but the Adjudicator was not satisfied that notice of the Hearing had been received by the Respondent and notice of the second Hearing was sent to the registered office of the Respondent, a forwarding address for post that had been left by the Respondent at the premises where the Complainant worked and the home address of two Directors. There was no Representative of the Respondent present at the reconvened Hearing on July 7th 2026. |
Summary of Complainant’s case;
The Complainant was employed as a Senior Office Administrator from March 24th 2025 to June 13th 2025 and sought payment for unpaid wages for the period from June 2nd to June 13th 2025 amounting to 1,354 Euros. The Complainant also sought payment of one weeks statutory notice pay. |
Summary of Respondent’s Case:
A Complaint was received by the Director General of the Workplace Relations Commission by the Complainant on July 10th 2025 alleging that her former employer contravened the provisions of the Payment of Wages Act 1977 in relation to her. The said complaint was referred to me for investigation. A Hearing for that purpose was held on July 2nd 2026. There was no appearance by or on behalf of the Respondent at the Hearing. I am satisfied that the said Respondent and two of its Directors were informed in writing of the date, time and place at which the Hearing to investigate the complaint would be held and were not present at the Hearing. |
Findings and Conclusions:
Based on the uncontested evidence of the Complainant I find she is entitled to unpaid wages of 1,354 Euros. The Minimum Notice and Terms of Employment Act 1973 requires an Employee to have 13 weeks employment before they become entitled to statutory notice pay. The Complainant did not have the service to meet this statutory requirement. This complaint was submitted as part of the Payment of Wages compliant and has no separate Complaint number. As the payment was not properly payable the aspect f the complaint relating to statutory notice pay is not well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
I find the complaint well founded and award the Complainant 1,354 Euros. (CA-00073300-001) |
