Procedure:
In accordance with Section 41 of the Workplace Relations Act, and/or Section 79 of the Employment Equality Acts, 1998 - 2015, and/or Section 25 of the Equal Status Act, 2000,following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Background:
This matter was heard by way of remote hearing pursuant to the Civil Law and Criminal Law (Miscellaneous Provisions) Act, 2020 and S.I. No. 359/2020 which designates the WRC as a body empowered to hold remote hearings. The initial hearing was adjourned due to technical difficulties; the complainant did not attend the reconvened hearing. The respondent was represented at the hearing. |

Findings and Conclusions:
The hearing began with a 15-minute pause to allow the complainant to contact the WRC or to enter the remote hearing, but no contact was made. He did not attend the hearing which proceeded following the pause. The complainant has not provided any reason for his non-attendance at the hearing As the complainant did not attend the hearing, no evidence of a contravention of the Acts was established. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.
CA-00067099-001 Equal Status Having regard to the nonattendance of the complainant at the hearing, my decision is that no evidence of a contravention of the Acts has been established.
