Procedure:
In accordance with Section 8 of the Unfair Dismissals Acts, 1977 - 2015, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
I noted firstly that in her WRC complaint form, filed on 13 November 2024, the Complainant alleged that she was unfairly dismissed by the Respondent on 14 October 2024. She accepted at the WRC hearing however that she was in employment with the Respondent until 18 December 2024. I am satisfied therefore that she was still employed when this complaint was filed with the WRC on 13 November 2024 and had not been dismissed.
Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
I find that I do not have jurisdiction to hear this complaint for the reasons set out above. |
