Appeal of Adjudication Officer Decision No's: ADJ-00045255 (CA-00056108, IR-SC-00001285)
BACKGROUND:
The Employer appealed the Adjudication Officer’s Recommendation to the Labour Court on 7 March 2025 in accordance with Section 13(9) of the Industrial Relations Act, 1969. The Worker subsequently appealed the Adjudication Officer’s Recommendation on 12 March 2025.
A Labour Court hearing took place on 5 February 2026.
The following is the decision of the Court.
DECISION:
This is an appeal by both parties of decision IR-SC 00001285 of an Adjudication Officer. The issues in dispute between the parties arise from a grievance pursued by the Worker through the internal processes. The Worker is a long-term employee. This issue has been ongoing for a considerable length of time. Both parties read their submissions and in the main the timelines in respect of engagements between the parties were not disputed. The role of the Court in Industrial Relation cases is to see if it can assist the parties in resolving their dispute. Following some brief engagements the parties jointly identified a path to resolution. Having considered the submissions of the parties both oral and written, the Court recommends the jointly identified path to resolution, as the resolution of this dispute.
The appeals succeed. The decision of the Adjudication Officer is set aside.
