Procedure:
In accordance with section 13 of the Industrial Relations Act 1969 (as amended), this dispute was assigned to me for investigation by the Director General. A hearing was arranged for Tuesday, January 27th 2026 at 09.30. The subject matter is a dispute under section 13 of the Industrial Relations Act 1969 and the hearing took place in private and the parties are not named. In accordance with the section 8 of the Industrial Relations Act 1990, they are referred to as “the worker” and “the employer.”
Ms Lisa Conroy of the Construction Industry Federation represented the employer. Ms Conroy was accompanied by Ms Eva Dendrinou. Two members of the respondent’s management team also attended the hearing; however, the worker did not attend. On the day before, at 13.17, he sent an email to the case officer at the WRC and said that he is currently off work due to work-related stress. He did not say that he would not attend the hearing.
I am satisfied that, by letter from the WRC on January 5th 2025, the worker was notified of the hearing of this dispute. In the absence of a request for an adjournment, I have reached the conclusion below.
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
In the circumstances in which the worker did not attend the hearing, I recommend that the parties take no further action regarding the matter in dispute. |
