Complaint seeking adjudication by the Workplace Relations Commission under section 13 of the Industrial Relations Act, 1969 | IR - SC - 00005056 | 29/08/2025 |
Workplace Relations Commission Adjudication Officer: Brian Dalton
Date of Hearing: 26/01/2026
Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended) following the referral of the dispute(s) to me by the Director General, I inquired into the dispute(s) and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute(s).
Background:
The Complainant made several complaints about unsafe working conditions and alleged that arising from making safety complaints he was dismissed. He failed to attend at the hearing. He consented to email communication. I am satisfied that he was notified of the date, time and place of the hearing. The Respondent attended at the hearing and was ready to rebut the allegations being made. As the worker failed to attend the dispute cannot be properly examined and a recommendation in these circumstances to resolve the dispute is not possible. |
Summary of Workers Case:
The worker failed to attend |
Summary of Employer’s Case:
The employer disputed the allegations being made against them. |
Conclusions:
In conducting my investigation, I have taken into account all relevant submissions presented to me by the parties.
|
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
