Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint. This matter was heard by way of remote hearing pursuant to the Civil Law and Criminal Law (Miscellaneous Provisions) Act, 2020 and S.I. 359 of 2020, which designates the WRC as a body empowered to hold remote hearings. All evidence was given on oath or affirmation and subject to cross-examination.
Background:
The Complainant worked full-time for the Respondent from company from 23/04/2023 to 31/05/2025, as an engineer, on a monthly salary of €4,593.33 gross, based on a 39 hour week. When he concluded his employment, he was issued with a final payslip, which set out that month’s salary and also payment in respect of his outstanding annual leave. However, he received no monies in respect of that payslip, at the time, or since. The total amount set out in that payslip, which he submitted to the WRC is €9,846.96 gross (€6,296.77 NETT, after lawful, statutory deductions). He filed a WRC complaint on 6/10/2025 for adjudication, seeking payment of the outstanding monies owed to him, seeking €6,296.77, under the Payment of Wages Act 1991.
No appearance was entered by or on behalf of the Respondent. I allowed a fifteen (15) minute grace period, in ease of the Respondent. As no appearance was entered during that time, I proceeded in its absence. |
Summary of Complainant’s Case:
The Complainant took the affirmation and gave evidence on his own behalf. The Complainant worked full-time for the Respondent company from 23/04/2023 to 31/05/2025, as an engineer, on a monthly salary of €4,593.33 gross.

Findings and Conclusions:
I find that this complaint is well founded. I found the Complainant to be a compelling witness.
I accept his uncontested evidence that the company issued him with a final payslip (which he submitted) dated 23/05/2025, in the amount of €9,846.96 gross (broken down as €10.87 referring to ‘overtime’, €4,593.33 referring to ‘basic salary’ and €5,242.76 referring to ‘holiday pay’), which after lawful statutory deductions came out to €6,296.77 NETT, but did not pay him any amount set out in his final payslip, at the time, or, at any time since, in the intervening seven (7) months.
I note that he had previously difficulties getting paid by the same employer, when there was a delay in receiving his salary, which he outlined had been successfully resolved after referring the matter to the WRC Inspectorate.
On this occasion, the matter remained unresolved, and he therefore had to refer it for WRC adjudication. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
I find for the Complainant.
I direct the Respondent to pay the Complainant the amount of €6,296.77 sought by the Complainant, and as per the terms of his final payslip issued to him, dated 23/05/2025, within 42 days of the date of this decision.
