Procedure:
In accordance with Section 41 of the Workplace Relations Act 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard and to present to me any evidence relevant to the complaint.
This matter was heard by way of a remote hearing on the 10th February 2026 pursuant to the Civil Law and Criminal Law (Miscellaneous Provisions) Act 2020 and S.I. 359/2020, which designated the WRC as a body empowered to hold remote hearings.
The Respondent was in attendance and was represented by Lisa Shannon of Squire Patton Boggs.
At the time the hearing was to commence, it was apparent that there was no attendance by or on behalf of the Complainant. I verified that the Complainant was on notice of the date, time and venue of the hearing and waited some time to accommodate a late arrival. The Complainant did not attend and I opened the hearing.
The Respondent’s Head of People and Culture confirmed the correct legal name for the Respondent which is cited on consent in this Decision.
Summary of Complainant’s Case:
The Complainant did not attend the scheduled hearing of this complaint. Notice of the hearing arrangements was sent to the Complainant on the 19th January 2026. No explanation for the Complainant’s non-attendance at the hearing has been received by the WRC. |
Summary of Respondent’s Case:
The Respondent attended the hearing and was prepared to present evidence. The Respondent denied the complaint and stated that the Complainant was paid all wages due and owing to her. |
Findings and Conclusions:
A complaint pursuant to the Payment of Wages Act 1991 was received by the WRC on the 1st September 2025. The said complaint was referred to me for investigation. A hearing for that purpose was scheduled for the 10th January 2026. At the time the hearing was to commence, it was apparent that there was no attendance by or on behalf of the Complainant. I verified that the Complainant was on notice of the date, time and venue of the hearing and waited some time to accommodate a late arrival. The Complainant did not attend the hearing. The Respondent was in attendance and confirmed that the Complainant was paid all wages due and owing to her. In the circumstances, and in the absence of direct evidence, I conclude that the complaint is not well-founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
For the reasons set out above, I find that the complaint is not well-founded and I decide accordingly. |
