Procedure:

This complaint was submitted to the WRC on August 5th 2025 and, in accordance with Section 41 of the Workplace Relations Act, it was assigned to me by the Director General. A hearing was arranged for February 19th 2026 at 9.30am, for the parties to present evidence in respect of the complaint; however, neither the complainant nor the respondent attended at the appointed time. The case file contains correspondence from both parties concerning the hearing. On January 16th 2026, the complainant sought clarification regarding the possible outcome from an investigation into his complaint and this was provided to him in writing on January 21st. Having received this clarification, the complainant did not inform the WRC that he would not be attend and a time and date was set aside for the hearing. I am satisfied that both parties were properly on notice of the hearing. When neither party was present at 10.00am on February 19th, and, with no contact regarding an explanation for not attending, I reached the decision set out below.

Decision:

Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.

In the circumstances in which the complainant and the respondent did not attend the hearing, and in the absence of any evidence to the contrary having been submitted, I must conclude that this complaint is not well founded and I decide accordingly.
