Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
This is a payment of wages claim, and the Respondent employer wrote to the WRC to state that the payments had been made relating to this claim for unlawful deduction of wages. However, no contact was made with the Commission by the Complainant to withdraw the complaint. |

The Complainant failed to attend or to communicate with the Commission that he was withdrawing his complaint. |

The Respondent failed to attend. |
Findings and Conclusions:
The Complainant failed to attend at the hearing. He consented to communication by electronic mail, and I am satisfied that he was notified of the date, time and place of the hearing. In these circumstances I must dismiss the claim for failing to attend. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
I dismiss the claim arising from the non-attendance at the hearing by the Complainant and I find that the complaint is not well founded. |
