Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 13 of the Industrial Relations Acts 1969 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background:
The Complainant commenced her employment on 10/06/2025 and ended on 02/07/2025 as detailed on the complaint form. She was employed as customer services representative. The Complainant consented to email communication relating to the case. |
Summary of Complainant’s Case:
The Complainant failed to attend at the hearing. |
Summary of Respondent’s Case:
The Respondent attended at the hearing and was ready to rebut the allegations made against them. |
Findings and Conclusions:
I am satisfied that the Complainant was notified of the date, time and place of the hearing and failed to attend. The Complainant failed to attend, and the Respondent was in attendance. The Complainant made no contact with the Commission to either withdraw their complaint or to provide any explanation of their nonattendance at the scheduled hearing. In these circumstances I must dismiss all complaints against the Respondent. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 13 of the Industrial Relations Acts, 1969 requires that I make a recommendation in relation to the dispute.
CA-00073052-003 Organisation Working Time Act 1997: The Complainant stated in her form: “I was penalised or threatened with penalisation for opposing in good faith an action that is unlawful or giving notice of my intention of doing so under the Organisation of Working Time Act 1997.” I find that this complaint is not well founded for failure to attend at the hearing and dismiss the complaint. CA-00073052-004 the Unfair Dismissals Act 1977: The Complainant stated in her form: “I was dismissed by my employer for having made a protected disclosure” I find that the Complainant was not penalised for making a protected disclosure and was not Unfairly Dismissed and dismiss the complaint for failure to attend at the hearing.
