Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
As the facts were very similar, this complaint was heard in conjunction with ADJ 56855.
Background:
The Complainant stated that she was not paid her salary on time in November 2024. |
Summary of Complainant’s Case:
The Complainant stated that she was paid her salary late in November 2024. Specifically, she was paid half of her salary on 8 November 2024 and the remaining half on 12 November 2024. |
Summary of Respondent’s Case:
The Respondent acknowledged that the Complainant was paid her salary late in November 2024. |
Findings and Conclusions:
Section 6 of the Payment of Wages Act states that an employee may present a complaint to the WRC that his or her employer has contravened section 5 of the Act. As such an Adjudication Officer only has powers under section 5 of the Act. As there is no provision in section 5 of the Act in relation to the late payment of wages that are ultimately paid, I find that this complaint is not well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complain in accordance with the relevant redress provisions under Schedule 6 of that Act.
I find that this complaint is not well founded for the reasons set out above. |
