Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended) following the referral of the dispute(s) to me by the Director General, I inquired into the dispute(s) and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute(s).
The parties agreed in the hearing that the name of the Employer should be amended to reflect their actual name rather than trading name.
Background:
The Worker was employed by the Employer for approximately 20 months. In January 2026 he was informed of two complaints against him which the Employer then moved to investigate. |
Summary of Workers Case:
The Worker submits that he was subject to false allegations made by a colleague. These were supported by a further complaint made by a member of the public who turned out to be a family member of that colleague and who had never attended the workplace. The Worker believes that the manager who initiated the process was conflicted. |
Summary of Employer’s Case:
The Employer submits that this investigation never concluded. It was paused pending a complaint submitted by the Worker and then the Worker subsequently resigned. |
Conclusions:
In conducting my investigation, I have taken into account all relevant submissions presented to me by the parties.
No disciplinary outcome issued from the process which this trade dispute relates to. The employment relationship has now ended. In the circumstances I do not see any reasonable recommendation I can make which would help resolve any trade dispute. I also note that the Worker has filed subsequent employment rights complaints related to the ending of the employment relationship, including under the Unfair Dismissals Act, which he is still pursuing. Further investigation of this dispute might result in an issue arising under section 8 subsection 10 of the Unfair Dismissals Act. |
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
I recommend no specific course of action.
