Date of Adjudication Hearing: 30/07/2026
Workplace Relations Commission Adjudication Officer: Brian Dalton
Procedure:
In accordance with Section 79 of the Employment Equality Acts, 1998 - 2015, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant brought several equality complaints including discrimination on the ground of race and harassment.
The Complainant consented to being communicated by email and was notified of the hearing date on the 12th of June 2026 as follows:
Notification of Hearing The following are the arrangements for the Hearing of the above case:
The Complainant failed to attend at the hearing. The Respondent attended and was ready to rebut the allegations being made against them.
|
Summary of Complainant’s Case:
The Complainant failed to attend. |
Summary of Respondent’s Case:
The Respondent attended and submitted a detailed written submission prior to the hearing and was ready to rebut the allegations being made against them. |
Findings and Conclusions:
I am satisfied that the Complainant was properly notified of the hearing date, time and place and failed to attend. As the Complainant failed to attend to present their case, I must find that the complaints being brought against the Respondent are not well founded for failure to appear. I determine that the Complainant was not discriminated against on the ground of race and was not harassed and all acts of alleged discrimination as set out in the Complainant’s narrative are dismissed. |
Decision:
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
The complaints brought under the Employment Equality Act 1998 as amended are not well founded. I find that the Complainant was not discriminated against. |
