Date of Adjudication Hearing: 21/08/2026
Workplace Relations Commission Adjudication Officer: Conor Stokes
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
This matter was heard by way of remote hearing pursuant to the Civil Law and Criminal Law (Miscellaneous Provisions) Act, 2020 and S.I. No. 359/2020 which designates the WRC as a body empowered to hold remote hearings. The complainant did not attend the hearing, four attendees and a representative appeared for the respondent. The complainant indicated to the concierge at the start of the hearing that he did not intend to appear for the hearing. The hearing formally opened and closed shortly afterwards. |
Summary of Complainant’s Case:
The complainant did not attend the hearing. |
Summary of Respondent’s Case:
Two witnesses and two observers for the respondent attended the hearing along with their representative. |
Findings and Conclusions:
At the start of the hearing, the complainant informed the concierge that he would not be attending the scheduled hearing. He did not provide any reason for his non-attendance at the hearing. As the complainant did not attend the hearing, I find that no evidence of a contravention of the Act was established. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Having regard to the circumstances of this complaint and hearing, my decision is that the Act was not contravened. |
