Workplace Relations Commission Adjudication Officer: Lefre de Burgh
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint. All evidence was given on oath or affirmation, and subject to cross-examination. This matter was heard by way of remote (hybrid) hearing pursuant to the Civil Law and Criminal Law (Miscellaneous Provisions) Act 2020 and SI 359/20206, which designates the WRC as a body empowered to hold remote hearings.
Background:
This case is linked to ADJ-00059556. This is a duplicate complaint. This matter was heard under ADJ-00059556, CA-00072454-001. |
Summary of Complainant’s Case:
The Complainant submits that he did not receive a contract of employment, at any point during his period of employment. |
Summary of Respondent’s Case:
The Respondent concedes that no formal contract of employment was provided, but submits that the Complainant was at all times on notice of his main terms of employment, that he was provided (via Whatsapp message) with the core terms of his employment, including his rate of pay, which had been negotiated between the parties in person, and that the Complainant suffered minimal prejudice and is therefore seeking that no harsh redress be imposed. |
Findings and Conclusions:
This is a duplicate complaint, which is dealt with in ADJ-00059556, CA-00072454-001. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
CA-00075760-001 - This is a duplicate complaint. I therefore find that this is not well founded. |
