Complaint(s):
Act | Complaint/Dispute Reference No. | Date of Receipt |
Complaint seeking adjudication by the Workplace Relations Commission under Section 21 Equal Status Act, 2000 | CA-00075135-001 | 04/09/2025 |
Date of Adjudication Hearing: 26/05/2026 and28/07/2026
Workplace Relations Commission Adjudication Officer: Breiffni O'Neill
Procedure:
In accordance with Section 25 of the Equal Status Act, 2000, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
The hearing was initially held remotely on 26 May 2026 and both parties were in attendance. At the outset, I advised the Complainant that she had the option either to proceed on that day or to seek an adjournment, as she had stated that she had not yet had an opportunity to review the Respondent’s submissions. The Complainant elected to seek to adjourn the hearing, and I agreed to do so. It was then agreed by both parties that the hearing would resume on a face-to-face basis in Dublin within the following 8 to 10 weeks.
Background:
In her complaint form submitted to the WRC, the Complainant stated that, while shopping in one of the Respondent’s shops with her daughter, she was stopped by a security guard at the self-service tills and asked to produce her receipt. The Complainant stated that she felt embarrassed by the interaction, questioned why she had been selected for a receipt check, and alleged that she was asked to leave the store after challenging the request. She stated that this was discriminatory. |
Summary of Complainant’s Case:
The Complainant did not attend the hearing day on 28/07/2026 and failed to present any evidence in relation to her complaint. |
Summary of Respondent’s Case:
As the Complainant did not attend the hearing day on 28/07/2026 and did not present any evidence in relation to her complaint, the Respondent did not present any evidence. |
Findings and Conclusions:
As the Complainant did not attend the hearing day on 28/07/2026 and did not present any evidence in relation to her complaint, I find that she failed to establish a prima facie of discrimination. |
Decision:
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.
As the Complainant failed to establish a prima facie of discrimination, I find that the Respondent did not engage in prohibited conduct. |
