Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended) following the referral of the dispute(s) to me by the Director General, I inquired into the dispute(s) and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute(s).
Background:
The Worker was employed by the Employer for a period of approximately seven weeks before resigning. |
Summary of Workers Case:
The Worker submitted a trade dispute alleging constructive dismissal. They did not attend the hearing. |
Summary of Employer’s Case:
The Employer attended the hearing and made written submissions beforehand. They sought to discourage the Worker from resigning and instead avail of their grievance procedure to resolve any issues they had at work. |
Conclusions:
In conducting my investigation, I have taken into account all relevant submissions presented to me by the parties. The Worker did not attend the hearing and present their case. In the circumstances I do not see any pertinent recommendations I can make. |
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
I recommend that the Employer take no further action in relation to this dispute.
