Procedure:
In accordance with section 13 of the Industrial Relations Act 1969 (as amended), this dispute was assigned to me for investigation by the Director General. A hearing was arranged for Thursday, April 9th 2026 at 09.30am. The subject matter is a dispute under section 13 of the Industrial Relations Act 1969 and the parties are not named. In accordance with the section 8 of the Industrial Relations Act 1990, they are referred to as “the worker” and “the employer.”
Neither the worker or the employer attended the hearing, and they did not contact the WRC to explain the reason for their non-attendance.
I note from the documents on the case file that the respondent informed the WRC on March 3rd that the matters which are the subject of this referral were considered at a previous hearing and that the recommendation has been appealed to the Labour Court by the worker.
The case file includes copies of letters dated February 3rd 2026, sent to the parties by email to the addresses they provided to the WRC. The purpose of the letters was to notify them of the date and time of the hearing on April 9th. I am satisfied therefore, that the worker and the employer had 11 weeks’ notice of the hearing and, in the absence of any explanation for not attending, I have reached the conclusion below.
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
In the circumstances in which they did not attend the hearing, I recommend that the parties take no further action regarding the matter in dispute. |
