Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended) following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute.
Civil Law and Criminal Law (Miscellaneous Provisions) Act 2020 and S.I. 359/2020
- The matter was heard by way of remote hearing pursuant to the Civil Law and Criminal Law (Miscellaneous Provisions) Act 2020 and S.I. 359/2020, which designated the WRC as a body empowered to hold remote hearings.

The Worker made serious allegations and the failed to appear to pursue his case. |
Summary of Workers Case:
The Worker began working with the Employer on 20/06/2025 and the employment ended on the 02/08/25. The Worker sets out that he was assaulted at work and has contacted An Garda Siochana to report the assault and has lodged this s13 claim. |
Summary of Employer’s Case:
The Employer attended and completely rejected the assertions of the Worker. |
Conclusions:
The complainant did not attend the hearing on the scheduled date and time. The Case Officer made several attempts to contact him on the day with no response. Having reviewed the correspondence issued and the delivery records on file, I am satisfied that the complainant was properly on notice of the hearing and that reasonable efforts were made to inform them of the arrangements. In the absence of any request for an adjournment or explanation for non‑attendance, I proceeded to deal with the matter in accordance with the relevant procedures.

Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
